BY USING ROUTELETTE, YOU ACKNOWLEDGE THAT DRIVING INVOLVES INHERENT RISKS AND YOU ASSUME ALL RESPONSIBILITY FOR YOUR SAFETY AND THE SAFETY OF OTHERS. WE ARE NOT LIABLE FOR ANY ACCIDENTS, INJURIES, OR DAMAGES THAT MAY OCCUR.

1. Acceptance of Terms

By downloading, installing, or using the Routelette mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Routelette is a mobile application that generates random driving routes based on user preferences and location data. The App provides route suggestions for recreational and exploratory purposes only.

3. DISCLAIMER OF LIABILITY AND WARRANTIES

3.1 Route Accuracy and Safety

ROUTELETTE PROVIDES ROUTE SUGGESTIONS "AS-IS" WITHOUT ANY WARRANTIES OR GUARANTEES REGARDING:

Route accuracy, safety, or accessibility
Road conditions, closures, or construction
Traffic laws, restrictions, or regulations
Private property boundaries or trespassing issues
Weather conditions or seasonal accessibility
Vehicle suitability for suggested routes

3.2 No Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUTELETTE AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

Any accidents, injuries, or deaths arising from use of suggested routes
Property damage or vehicle damage
Traffic violations or legal penalties
Getting lost, stranded, or delayed
Trespassing or unauthorized access to private property
Any direct, indirect, incidental, special, or consequential damages

4. User Responsibilities

4.1 Safe Driving Practices

You agree to:

Verify all routes before driving using official maps and local knowledge
Obey all traffic laws and road signs regardless of app suggestions
Drive safely and defensively at all times
Not use the App while driving - pull over safely to interact with the device
Use proper navigation equipment and not rely solely on Routelette
Exercise independent judgment about route safety and legality

4.2 Route Verification

You are solely responsible for:

Confirming routes are legal and accessible
Checking for road closures, construction, or hazards
Ensuring your vehicle is suitable for the terrain
Obtaining permission for private roads or property access
Checking weather and seasonal conditions

5. Prohibited Uses

You may not use the App:

For commercial transportation or delivery services
For emergency or time-critical travel
In violation of any local, state, or federal laws
To access private property without permission
While under the influence of alcohol or drugs

6. Third-Party Services

The App may integrate with third-party mapping services (Google Maps, etc.). Your use of these services is subject to their respective terms of service. We are not responsible for the accuracy or availability of third-party services.

7. Indemnification

You agree to indemnify, defend, and hold harmless Routelette and its affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the App or violation of these Terms.

8. Limitation of Liability

IN NO EVENT SHALL ROUTELETTE'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY.

9. Dispute Resolution

9.1 Binding Arbitration

Any disputes arising from these Terms or use of the App shall be resolved through binding arbitration rather than in court, except for small claims court actions.

9.2 Class Action Waiver

You waive any right to participate in class action lawsuits or class-wide arbitration against Routelette.

10. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
